Misdemeanor

What is a Misdemeanor?

Crimes in the United States are split up into two different categories; misdemeanors and felonies. In the US, misdemeanors are the lesser of the two, carrying a maximum sentence of one year in jail. If convicted of a felony, the maximum sentence is much more severe and can result in jail time greater than one year.

What are the Consequences for a Misdemeanor?

The most common consequences for committing a misdemeanor is jail time. Depending on the severity of the crime, jail time can be up to one year. Fines are also associated with misdemeanors. These fines are relatively small, usually not resulting in more than $2000. Being convicted of a misdemeanor also could result in a loss of a licence, drivers or otherwise. Also, if someone commits a misdemeanor while they hold a public office position, they may lose this position. Future job opportunities may also be at risk.

Will a Misdemeanor Go On Your Permanent Record?

Even though misdemeanors are much less severe than felonies, they will still show up on your permanent record. This means that anytime someone performs a background check, the misdemeanor will show up. While employers are generally more concerned with felonies than misdemeanors, having something on your permanent record may send some red flags and affect your chances at employment.

Can You Get A Misdemeanor Off Your Record?

It is possible to get a misdemeanor off your record through expungement. Expunging your record means getting your record sealed so that the misdemeanor will not show up. The expungement process, while possible, is difficult and lengthy. It is best to consult an experienced criminal defense attorney when dealing with expunging your record.

Expunging your record opens up many possibilities including a better chance at employment, getting a loan, obtaining various licences, and peace of mind.
