A Summary of San Diego’s (or California’s) Newest Laws and How They Affect You

Laws are constantly changing to accommodate new technologies, trends in crime, and societal changes. It can be difficult to keep up with all of the new laws as they are passed and enforced. As an experienced San Diego criminal defense attorney, I’ve gathered a few of San Diego’s (or California’s) newest laws for you to learn and review.

Driving and Cell Phone Use

Drivers in California are prohibited from using handheld wireless phones or wireless electronic devices on the road. If you want to use your phone while driving, it must be mounted on your windshield without blocking your view. You must be able to activate the desired feature with a single swipe or tap while it is mounted.

Rear-Facing Car Seats

The new law requires all children under two years old to sit in rear-facing car seats in California. While you aren’t likely to get pulled over for this infraction, you could face additional fines for other offenses. Children who weigh more than 40 pounds or are taller than 40 inches are exempt from the law.

Barbershops and Beers

AB1322 allows salons and barbershops to provide free wine or beer to their customers without an alcohol license.

Human Trafficking

The new law states that people under the age of 18 cannot be charged with prostitution. In an efforts to go after human trafficking, they will be treated as victims.

Right-to-Die

This law allows terminally ill patients to use experimental drugs to choose when they would like to end their lives. Health plans will be authorized, but not required, to cover these drugs. Physicians will be protected from disciplinary action if these drugs are recommended after all other treatment options have been exhausted.

Pets in Cars

If a bystander breaks into a parked vehicle to save an animal from overheating, they will be protected from liability under AB 797.

Minimum Wage

The minimum wage increased from $10 to $10.50 an hour. This law affects all businesses with 26 or more employees.

Sex Crime Prison Sentences

Under AB 2888, probation-only sentences for sexual assault crimes will be banned. This law also sets mandatory prison sentences. SB 1322 also eliminates the criminal statute of limitations for rape cases.

Health Protocol for Youth Sports

Under the new law, parents or guardians must be notified by the youth sports organizations if athletes under the age of 17 are removed from an activity based on a suspected concussion. Coaches and administrators will also be required to attend head injury and concussion education annually.

Juvenile Crime History

Under AB 1843, employers will not be allowed to ask for or consider juvenile convictions while hiring.

Gun Laws

The new laws put restrictions on gun owners loaning firearms. It also criminalizes false reports of stolen or lost guns. Gun owners, including law enforcement personnel, will be required to secure guns in unattended vehicles. Voters also passed a law that requires gun owners with magazines with more than 10 rounds to give them up starting July 1. Buyers will not be allowed to buy new weapons with a bullet button.

Digital Assets in Death

This law provides a process to follow in order to access and manage a person’s electronic communications and assets following their death.
